LCBA SEPTEMBER MEETING THURSDAY, SEPTEMBER 16

The September meeting of the Linn County Bar Association will be held Thursday, September 16, 2010, from 12 – 1 p.m.  at the Cedar Rapids Museum of Art on Third Avenue SE across from Greene Square Park  The meeting room is located on the third floor. Parking is available behind the building on the Second Avenue side.  The speakers will be  Justice David Baker of the Iowa Supreme Court and Chief Judge Patrick Grady of the 6th Judicial District.  Lunch will be catered by Biaggi’s.  The cost is $7.

RSVPs are required only if you plan to attend.   Rebekah Isbell, assistant to LCBA Attendance Chair Corinne R. Butkowski, will send all LCBA members a RSVP-request email in early September.  Please respond to Rebekah’s email by 2:00 p.m. on Wednesday, September 15, 2010.

PLEASE make sure to RSVP if you are attending so that we order sufficient food from the caterer.  Also, if you DO RSVP but discover last minute you cannot attend, please try to send one of your colleagues in your place.  We have had trouble ordering the correct quantity of food  for our meetings because members often fail to RSVP and then show up for the meeting, or RSVP but do not attend.  Unfortunately, the number of members in these two categories often invariably do not even out, resulting in us running out of food sometimes (which isn’t fair to those in attendance) or ordering too much food thereby wasting both food and bar association money.

FREE FAMILY LAW CLE TUESDAY, AUGUST 31
Kids First is holding a one-day CLE entitled “Putting Kids First: Providing Effective Child Representation in Custody Cases” on Tuesday, August 31 from 8:30 am to 3:30 pm in downtown Cedar Rapids.    Registration is due Monday!

Attorneys from every practice area would enjoy this CLE and will gain valuable information that can be used whenever interacting with children in one’s practice. The CLE will include, among other sessions:

·         The role of a child’s representative,

·         Representing a child from start to finish in a custody case,

·         A panel of judges speak about their preferences regarding children in the courtroom,

·         A panel of child/family therapists discuss how to work with them on a custody case (obtaining mental health records, subpoenas, etc.),

·         Tips for meeting with and interviewing children, and

·         An hour of coveted ethics CLE on Bart Simpson’s family’s divorce.

Kids First is applying for 6.5 hours of CLE, including 1 hour of ethics.  The fee for the CLE is a mere $100. A catered lunch is included in the price. Space for the training is limited, so don’t delay! Email Jenny Schulz at jenny@kidsfirstiowa.org or call 365-5437 for a registration form.

SIXTH JUDICIAL DISTRICT JUDGE VACANCY; SEPTEMBER 9 DEADLINE
A vacancy exists in the office of District Judge for the Sixth Judicial District due to the retirement of Judge Kristin Hibbs.   Applicants for the judge position must  deliver a completed application   to the office of the District Court Administrator, Linn County Courthouse, P.O. Box 5488, Cedar Rapids, Iowa, no later than 3:00 p.m., Thursday, September 9, 2010, and a copy sent to each Commissioner by that same date and time at the addresses listed.  State prescribed applications may be picked up at the Court Administration Office or a copy of the application may be requested via e-mail from harold.soppe@iowacourts.gov.   Please click on this link to see the official Notice and for more information.
LINN LAW CLUB SOCIAL THURSDAY, SEPTEMBER 23

The Linn Law Club will be holding a social get-together at Dublin City Pub on Thursday, September 23 to welcome new members.   Festivities will start at 4:30 p.m.  All members of Linn Law Club, or anyone who would like to join Law Club, are invited and encouraged to attend. The Linn Law Club is open to all attorneys 35 and under, or who have been  in law practice less than 10 years.

Dublin City Pub is located at 415 1st St. SE (across from the Ground Transportation Center).  The event will be held in the upstairs area of the restaurant.    Appetizers and refreshments will be provided.  No RSVPs are needed.  Any questions? IOWANS FOR FAIR & IMPARTIAL COURTS; JUSTICE O’CONNOR DES MOINES VISIT SEPTEMBER 8

Please see the attached letter from Iowa State Bar Association President Frank Carroll regarding the ISBA’s Iowans for Fair and Impartial Courts project, designed to address the current judicial retention election challenge.  The letter also discusses the upcoming visit by U.S. Supreme Court Justice Sandra Day O’Connor in Des Moines on September 8.

LCBA COMMITTEE APPOINTMENTS UNDERWAY

Did you know the Linn County Bar Association publishes each day’s court schedules for Linn County District Court, Associate Court and Small Claims/Traffic court?  Just head over to the LCBA website at www.linncobar.org and click on “Court Schedules & Info” at the top.  This section of the website also has links to judge assignments, local Orders and contact information for the court.

HOW TO JOIN THE LCBA  and DUES INFORMATION

Membership in the LCBA is open to lawyers admitted to practice in Iowa and who live or work in Linn County.  Click here for our LCBA Membership Application form.   Membership in the LCBA is free the first year of membership.  Annual base membership dues for all others are as follows:

– Attorneys who have practiced for fewer than 5 years: $95
– Attorneys who have practiced for 5-49 years:  $125
– Attorneys who have practice for 50 or more years:  $0
– Attorneys over age 65 but no longer in practice:  $75

Annual dues invoices for 2010-2011 will be sent to members shortly.  Payment of dues should be sent to Linn County Bar Association, P.O. Box 74127, Cedar Rapids, IA 52407.

** Total dues amount to be remitted above does not include a voluntary $100 contribution per member for law-related charitable contributions and endowments made on behalf of the LCBA.

USURY RATE

In accordance with the provisions of Section 535.2(3)(a), 2009 Iowa Code, the Superintendent of Banking has determined that the maximum lawful rate of interest provided for in said section shall be 5.25% for the month of August.  Please note the exemption in subsection 2 of said Chapter 535.2.  The usury rate is available at www.idob.state.ia.us.

RESTAURANT REVIEWS

As a fun, new service to our members, we will be publishing monthly restaurant reviews written by two of our very own members.  Enjoy this month’s reviews!  Also, if you would like to suggest a new heading for this section of our newsletter … i.e. better than “Restaurant Reviews”…. please email us with your suggestion.  The LCBA member who submits the best heading entry will be awarded FREE entry to the September 16 bar meeting (which means a Biaggi’s meal for free!)  Submit your suggestions to webmaster@linncobar.org by September 10.

Croissant Du Jour

Croissant Du Jour is a French Cafe. Located at 3531 Mt Vernon Rd SE, the cafe is open from 6:30 a.m. to 4:00 p.m. serving breakfast and lunch and terrific pastry all day.  This is a true French cafe.  The owners/chef/manager have a French background and all the food is prepared as if they were located in Paris.

My wife and I have tasted many of their pastries and lunches.  For breakfast, I love the Croissant or a Chocolate Eclair or maybe a Chocolate Croissant or maybe a Brioche, either raisin or chocolate.For lunch I have savored the Lobster Bisque with a 1/2 sandwich like the Le Cob, Le Parisian, or Le Jambon.  Another great choice that both my wife and I enjoy is the Nicoise, which is albacore tuna mixed with mayo, lettuce, tomato and a hard boiled egg with vinaigrette on a baguette.  They also have salads and the best crustless Quiche, a favorite of my wife and very tasty.  I tried it!  It is very good.

This Cafe is a treasure  for our community.  Prices are reasonable. The service is good.  They host private parties at which they serve French Cuisine dinners.  I have been fortunate to attend private parties at the Croissant Du Jour and the food is delectable.  I highly recommend the Croissant Du Jour.

The Motley Cow

The Motley Cow was formerly located in a small venue next to a pizza place just up from Johns Grocery on Market St. in Iowa City.  Its seating was limited to about five tables and mostly patronized by locals.  Now located in an expanded venue at 160 N. Linn St. across from the Linn Street Café and Devotay, it has retained its style and excellently prepared seasonal local fresh food.  The wait staff remains well trained and very pleasant.  We have dined frequently at both locations and have never been disappointed.  Our latest experience was an early Saturday evening before the students arrived back in town.

The Motley Cow has a limited but varied menu with an expansive wine list.  Be sure to note the salt and pepper shakers.  There is outdoor sidewalk seating and a small but nice bar as you enter with a view of the open kitchen.  Appetizers which caught our eye include ciabatta with hummus, house marinated olives and fried perch with garlic mayonnaise.  There is a “supper” and “dinner” menu.  The supper menu is a single course and includes a variety of creative pizzas, sandwiches, salads and special pasta with fresh ingredients.  The dinner entrée include either a house salad or seasonal soup.  The salad has a choice of sherry vinaigrette or buttermilk cumin dressing which are both excellent.  You may add one of the specialty salads to your dinner entrée for ½ prices.  We chose a grilled Lake Michigan whitefish and a western Iowa wabyu flank steak.  Both were very good.  There was also interesting vegetable lasagna on the menu. We asked for a recommendation on wine and our server suggested a very nice Argentinean Malbec at a reasonable price point.   The hit of the evening was the key lime pie—a must order for you sugar addicts.  Enough said—try the Motley Cow, you will not be disappointed.
